General terms and conditions of use
1. General provisions
1.1 The Porto Alegre Airport website at www.prd.portoalegre-airport.com.br (Portal do Aeroporto) is operated by:

(hereinafter referred to as "Fraport").
1.(2) These Terms and Conditions of Use apply to all interactions between Fraport and users of the Airport Portal, unless special terms and conditions of use or business or contracts with other providers using the Airport Website create more specific provisions for other services (e.g. parking, stores, airlines). The special terms and conditions applicable in each case can also be viewed on the Airport Portal or on the providers' linked pages.
1.3. Terms and conditions of business that deviate from, contradict or supplement these Terms and Conditions of Use shall not become part of the contract, unless Fraport explicitly agrees to them in writing.
1.4. Fraport reserves the right to adjust these Terms and Conditions of Use to account for future commercial, legal or technical developments.
1.(5) If the changes concern the subject matter of the contract, Fraport may only implement them if they are reasonable for the user, taking into account Fraport's interests. In particular, the changes will be considered reasonable for the user if they remain within the limits of usual practice on the Internet and do not discriminate against the user in violation of the principles of good faith.
2. Scope of Services
2.1. The Airport Portal is a free offer from Fraport to enable users to take advantage of selected airport-related information and services.
2.2 If Fraport does not provide the services mentioned in 2.1, Fraport will not become the user's contractual partner. Fraport is not responsible for the services of third parties hosted on the Portal (e.g. stores, airlines). All complaints about their services should be directed to them.
2.(3) Fraport plans to operate the Airport Portal on a long-term basis. However, the user has no legal right to use it in the future. If Fraport decides to cease operating the Airport Portal, Fraport will notify users in advance of this intention via the Portal.
2.(4) Fraport reserves the right to change, extend or reduce the content, structure and design of the Airport Portal within the scope of usual Internet practice.
2.5. Fraport has the right to temporarily limit the usability of the Airport Portal, its individual functions or access to it, if there are legal or technical reasons for doing so. In particular, these technical reasons may be, but are not limited to, maintenance work, updating of underlying software or measures to ensure the security or integrity of the Airport Portal.
3. Conduct on the Airport Portal
3.1. The Airport Portal and the underlying databases may only be used in the manner intended by Fraport. In particular, the information involved may only be accessed using an Internet browser.
3.(2) It is prohibited to:
a) circumventing or disabling functions (e.g. search windows) of the website or interfering in any way with the Airport Portal and, in particular, carrying out any action that may overload its infrastructure;
b) block, overwrite or modify content generated by Fraport; or
c) use automated functions (e.g. algorithms or machines) to obtain privileges or exploit vulnerabilities of any kind.
3.3:
a) acting in a fraudulent or misleading manner;
b) distribute, initiate or advertise spam, chain letters or pyramid schemes;
c) collect or in any way obtain and store information from or about other users and in particular e-mail addresses without their permission; or
d) send or make available viruses or other harmful software that may harm or damage the Airport Portal or the computer systems of other users.
4. Consequences of violations
4.(1) If there is concrete evidence of violations of these Terms and Conditions of Use, laws or other legal provisions, or the rights of third parties, Fraport reserves the right to take legal action against the violator.
5. Intellectual property
5.1. The content (texts, images, graphics, etc.) and information on the site are the intellectual property of Fraport or the providers. It is forbidden to reproduce, disseminate or process them without the consent of the party holding the rights. You may only use this content after obtaining the written consent of Fraport or the provider in question.
6. Limitation of liability
6.(1) Fraport is not responsible for the attributes, safety or legality of the products advertised by the providers.
6.2 To the extent that Fraport's liability is excluded or limited, this also applies to the personal liability of its employees, representatives and agents.
7. Links
7.1 Insofar as the Airport Portal contains links to third-party websites, Fraport is not responsible for their content. If the user follows such a link, they will leave behind the information provided by Fraport. Responsibility for the content of websites that can be accessed via an external link lies exclusively with their operators/providers. Only the latter are responsible for ensuring compliance with data privacy regulations when these sites are used.
8. Contractual language and applicable law
8.1. The Portuguese version of this agreement is legally binding.
8.(2) All items in these terms of use are governed by the laws in force in the Brazilian legal system. For all matters relating to interpretation, compliance or any other question relating to this term of use, the parties agree to submit to the jurisdiction of the District of Porto Alegre, with the exception of complaints submitted by users who fall within the legal concept of consumers, who may submit such complaints to the jurisdiction of their domicile.
